Defamation is it for the rich Essay Example | Topics and Well Written Essays - 7000 words

Defamation is it for the rich - Essay Example It is evident from the research that the law of defamation appears to be rather simple since a plaintiff seeking to substantiate a claim is generally required to establish that the defendant made/published defamatory statements and that those statements referred to the plaintiff or at the very least, any reasonable or objective person would conclude that the statements referred to the plaintiff. However, below the surface, there are barriers contained in common law precedents and statutory provisions that complicate an otherwise simple requirement to the extent that access to justice is not so straighforward. For instance, the word â€Å"malice† consistently appears in the Defamation Acts and case law although proof of malice is merely a theoretical requirement and is â€Å"purely formal†. As W. Horton explains:â€Å"Though the word (maliciously) is usually inserted in the plaintiff’s statement of claim, no one takes any notice of it at trial except for the purp ose of inflating damages where there has been spite or deliberateness.† Be that as it may, the overuse of the word malice is only a small token of the complexities with which act as an impediment to a straightforward defamation law suit. The more serious issues are found in the substantive law. For instance, defences such as fair comment and truth are typically available but will only protect opinionated statements and will do nothing to protect statements of fact. While there are other defences the underlying goal of defamation law is to provide for the accuracy and fairness of published or communicated statements.

Ethical Issues in Video Games

Ethical Issues in Video Games Are Ethics Important /Relevant in Visual Media? Discuss This essay aims to understand what video games are and which kind of ethical questions they pose from various perspectives and to determine which ethical problems video games pose. These issues will be described using ethical conceptual terms and will be explained using ethical theory to attempt to reach a verdict on the ethical nature of video games. Philosophers and ethicists are interested in the ethical dilemmas in the intersection of arts, culture and technology posed by video games, while game designers might be interested not only in the argument for ethics in games, but also the implementation of ethical discussion that may lead to more mature, challenging products. The term game covers a wide range of different activities and pastimes. Soccer, tennis, monopoly and Grand Theft Auto V (2014) can all be categorised as games, with very different experiences and rules. They do however; hold similar elements that define them as the same class. To understand what exactly games we can refer to Jesper Juulwho states that aÂÂ   game isÂÂ   a rule-based system withÂÂ   a variableÂÂ   andÂÂ   quantifiableÂÂ   outcome, where different outcomes are assigned different values, the player exerts effortÂÂ   inÂÂ   order to influence the out-come, the player feels attached to the outcome, and the consequencesÂÂ   ofÂÂ   theÂÂ   activityÂÂ   areÂÂ   optionalÂÂ   andÂÂ   negotiableÂÂ   (Juul, 2004). Video games are utilized through the use of computer power and the computer controls the rules in which the game is played with the player interacting through the use of a video display Juul merged different approaches and concepts to allow researchers to share their findingsin a common language. Juuls definition outlines the difference between the different levels of functionality and fundamental rules created in most games. (Miguel sicart, 2005)This means that video games can be analysed as self-contained worlds and systems separately and also how they interact with each other. Neither takes into account the player or the intentions the player has while interacting with the game. This separation is important while attempting to gain an ethical understanding of a game because it entrusts the player with moral attributes and gives the ability to the player to create their individual experiences based on their own values and cultural influences. In short, games are made up of a precise set of rules that creates a world that a player experiences. (Zimmerman Salen, 2003). It could also be said thata video game only exists when being interacted with even though it is possible to outline its rules, which are the objective nature and could be treated as a important part of the construction of the players experience. Understanding the ethics involved in video games will require the researcher to determine precisely how a computer game as an object with moral attributes and experiences is created. Aristotles distinction between potential and actuality can be used here. For example, if a player reads a rule book for a game of any type they can have an overall view of what that game consists of. It does not however, give the user a complete overview of the history of chess or many other elements of the game such as the type of player you are in competition against or a view of flaws that may be present in a particular opponents stra tegy. The substance of any type of game is not just its rules but also the practical existence of those rules. To fully understand this relationship we can use a classic distinction of Aristotelian metaphysics that is potentiality and actuality According to Aristotles metaphysics, things present a capability of evolving into a different and more complete state, this can also be referred to as the actuality of that thing. The classic example would be a boy being the potentiality of a man. Aristotle also argues that actuality is prior and has priority over actuality: before defining what the potentiality might be, we have to be aware of its actuality; and it is this actuality which is the reason why the potentiality is not only acquired, but developed. (Stanfordedu, 2016) In regards to video games, just like any other form of games, this means that the rules of a game are only viewed as the potential contained within the game, only by playing the game can we understand the potential places the game can be taken. In a game like Candy Crush (2014), different coloured pieces of candy fall down the screen and need to be matched with the same type candies, the goal is to avoid filling the screen are the conditions for the game that which the players abide by in order to play the game successfully. The rule set contains the ways the game can be played, but only the presence of a player will activate those potentialities and make them become a game (Miguel sicart, 2005)

Censorship :: essays research papers

What Happened To Our Rights? Censorship in America today has gotten way out of hand. There always seems to be some holier than thou group speaking out as if they were representing the majority of Americans. These groups want to censor just about anything and everything we do. When it comes to watching television, reading a book or magazine, listening to music, or buying products, people should be able to make these decisions for themselves. Where do we draw the line with censorship? After all we are Americans and we do have rights. Although censorship is needed with issues concerning children, majority of censorship is an infringement of our rights because what one person may find offensive and obscene does not necessarily represent all people and adults should have the right to make their own choices. The word censorship probably would not exist today if all people agreed upon all things. This however is not possible for we are all unique individuals and have our own likes and dislikes. For instance, a person who enjoys pornographic material has the right to read or view this material if he or she enjoys this type of material. On the other hand people who feel pornographic material is obscene or offensive and do not care to partake in it do not have to view or read this type of material. This material is not being forced upon anyone. Why take away something a person enjoys if it is not hurting anyone else? What people do in the privacy of their own home is their own business. Who’s to say what a person likes or enjoys is wrong because another person does not agree. Playboy and Penthouse magazines are read and enjoyed by many Americans today; however, many people find these magazines offensive and obscene and others find these magazines to be an excellent source of reading f or sexual entertainment. Years ago people tried to ban this type of magazine, now these magazines are in great demand and are available on shelves all around the world. The big question is who is right and who is wrong? Neither, because people have their own opinions, likes, and dislikes. After all this is America and we the people have rights as stated in the first amendment of the constitution. Adults should have the freedom to make their own choices in their everyday life. Whether the person’s choices are good or bad is irrelevant.

Boy in the Striped Pyjamas Film Essay

I am very distressed about living in this dreadful place. I absolutely hate it; I can’t believe we moved from the best house EVER!!! With 5 floors if you included the basement and the top floor with the window where if I stand on the end of my toes I could see the whole of Berlin, to this place which I’m pretty sure is the worst house ever. I miss Berlin so much but most of all I miss you and grandfather. This house is really small too, and I mean it is tiny! It only has 3 floors which means there is not a lot of exploring to be done like in Berlin, in Berlin I had explored every single place I could think of but then I find something new all of a sudden. Also mother and father don’t let me explore in the new back garden because it is ‘out of bounds’. What ever that means. There’s nothing to explore in the front garden either because it’s so small. Perplexed, I stood and gazed through my bedroom window. There were so many farmers working on one huge field with little huts that disappeared into the distance†¦ The thing that horrified me most of all was that even kids starting from the age of about 4 were working and they looked so anorexic. Each time the soldiers shouted the kids would huddle closer and closer together. They all seemed so scared as if they were being forced to, hmmm†¦ All of the farmers looked really skinny, almost anorexic. One of the farmers’ even works in our kitchen peeling all of the vegetables. I found it really tedious with nothing to do so I decided to make a swing. To make the swing I needed some rope which was easy to find, and a tire which was a little trickier†¦ I interrupted Gretel whilst she was flirting so I could ask lieutenant Kotler if he had a spare tire. After a long and boring chat he gave me one and I made my swing. Once I had finished building the swing, I enjoyed it really well. But then I fell and hurt my knee really bad. I thought I would bleed to death but then a farmer called Pavel that worked in our kitchen ran over and helped me. After he had cleaned and bandaged my cut mother had finally arrived. She had figured out what happened almost immediately, she did not look pleased.

Caferoma Case Study

Caferoma is a well known brand of coffee, promoted as an exclusive product with a strong and slightly bitter taste. The main problem is Caferoma's market share has declined by almost 30%. Let me Summarise the reasons for this change †¢ Consumers have become less loyal to the brand †¢ supermarkets are producing the similar products under their own label are selling at much lover prices †¢ Competing products have lower prices (30 to 40 %) †¢ Caferoma becoming less fashionable Brand image: not up to date s we can see from the chart 2 years ago Caferoma’s sales in Hotels was 30% but last year it was 25% in restaurants 2 years ago Caferoma’s sales was 10% but last year it was 15% In supemarkets 2 years ago their sales was 45% but last year it was 30% In specialist shops 2 years ago Caferoma’s sales was 10% but last year it was 25% Conducting the market survey we have the following results: Majority [m d r? t? ] people suppose Caferoma is old-fashio ned 70% of people think Caferoma has a good quality 60% of people consider that Caferoma is expensive little bit more than half of the respondents believe Caferoma is exclusive a less than half of people said Caferoma is value for money and almost a third of respondents think Caferoma is ecxiting. I can propose the following solution: Create a new coffee with a new taste and a new name for example „Cafferissimaâ€Å". To introduce the new coffee it will be good to have a limited edition (maybe coffee with taste of chilli). It is necessary to create a new package with an exclusive design for example in gold. Furthermore we give special introduction prices for both coffees.Most people want to try out new brands just to know how it tastes – this is our advantage. In order to bring the old brand back to life, will be a good idea to give small additional samples on the new coffee package of „Cafferissimaâ€Å". Moreover we need a new design of the logo, as the old on e is boring. There is no relation between this logo and the exclusive taste of the coffee. Maybe it could be similar to the package of Caferoma (golden, italic type). The next step will be a change of advertising. It is necessary to find the typical Italian style for old and young people.I think it would be great to have two different ads. One ad with an old woman, dressed very exclusively and the other one with a group of young people who are having fun, laughing and so on. But both ads will be made at the same place for example a typically Italien square. E-Mail To: From: Subject: RE:Caferoma decaffeinated; Premium Blend Date: 9th September Dear Mario, the first thing I have to mention is, that the „decaffeinated productâ€Å" is available in all supermarkets, but placed on botton shelves! Customers won't find the product as easy as other products.Most supermarkets sell their own brands because they make more money with it. I think that we can raise our profit by offering t he managers cash for displaying our product in a better position. Here some measures to improve the premium blend sales: As far as I can see, the price for the premium blend is too high and the packaging looks old-fashioned. Therefore we should reduce the price and launch a new packaging design. We should also start a new advertising campaign with focus on the brand's qualities. For instance some tasting sessions in big stores. Best regards
